If the case is not resolved based on these initial pleadings, the case will proceed through the discovery process. At the conclusion of the discovery process, one side may be entitled to judgment as a matter of law if there are no genuine facts in controversy and the law is clear as to who should prevail.
Otherwise, the case will proceed to trial before a judge or jury. Each side will have an opportunity to present evidence in support of its own claims as well as to rebut the claims of the opposing party. At the conclusion of the trial, the judge or jury will enter a verdict in favor of one party or the other.
